Contest Rules
These Official Rules ("Rules") apply to the Blue Seal Wild Bird Digital Photo Contest ("Contest") conducted by Kent Nutrition Group, Inc., 1600 Oregon Street, Muscatine, IA 52761 ("Sponsor"). By entering, you agree to be bound by these Rules. NO PURCHASE NECESSARY. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. SEE ENTRY SECTION FOR DETAILS.
1. PRIZES. One (1) Nine (9) day trip for two (2) to Costa Rica including a 7-day bird watching expedition (itinerary and trip details can be found at http://smithsonianjourneystraveladventures.com/tours/central_and_south_america/costa_rica_natures_museum.cfm)(estimated value $3,000 US); one (1) pair of Leupold® Katmai® binoculars (estimated value $325 US); one (1) Droll Yankees® Jagunda Bird Feeder with Auger (estimated value $90 US). Other prizes may be added to the Contest. Winner is responsible for any fees and delivery charges, in connection with the delivery of the prize. The prize may not be substituted, transferred or redeemed for cash. Kent Nutrition Group, Inc. does not make or is responsible or liable in any way for any warranty, representation or guarantee, express or implied, in fact or in law, relative to the prize including but not limited to its quality, fitness for purpose or mechanical condition. Winner agrees to look solely to the manufacturer of the prize for any warranty.
2. SELECTION OF WINNERS/ODDS OF WINNING. Winners will be selected based on subject matter, composition, creativity, technical quality and overall impression. The winners will be determined on or about March 15, 2011. A list of winners will be posted on www.blueseal.com upon determination of winners. Odds of winning depend on total number of eligible entries received.
3. CONTEST PERIOD. contest begins December 20th, 2010 at 12:00 a.m. EST and ends February 28th, 2011 at 11:59 p.m. EST ("Contest Period").
4. ENTRY. Entries will only be accepted through the means provided on www.blueseal.com ("Website"). Entrants must complete the contest form (www.blueseal.com/wildbird/contest/submit.php) and accept the contest rules and conditions laid out herein. Only entries submitted during the Contest Period are accepted. All entries must be accompanied by a digital photograph that must be formatted as either a JPG, JPEG, GIF or PNG; must be a file size less than 3MB. Entrant warrants and represents: (a) he/she is the sole and exclusive author and owner of the Submission and all rights therein; (b) he/she has the full and exclusive right, power and authority to submit the Submission and to grant the Sponsor the rights to the Submission herein granted, including but not limited to the worldwide copyright license, upon the terms and conditions set forth herein; (c) no rights in the Submission have been previously granted to any person, firm, corporation or other entity or otherwise exercised or made use of or encumbered in any way; (d) his/her Submission does not defame or invade publicity rights or the privacy of any person, living or deceased, or otherwise infringe upon any third party's copyright, trademark or any other personal or property rights. By submitting an entry, Entrant grants Sponsor a royalty-free, indefinite, world-wide license to use the submitted digital photograph and anything else submitted with the entry for commercial and any other purpose, including without limitation, the advertising, distribution, and sale of Sponsor’s products. Entrant shall indemnify, defend and hold harmless the Sponsor against any claims by any third party claiming ownership of any copyright, trademark or any other personal or property rights. Sponsor reserves the right in its sole discretion to disqualify any Submission at any time in the event it determines a Submission is offensive, inappropriate, not in keeping with Sponsor's image or if it determines that the entrant has not otherwise complied with any portion of these Official Rules. Entries generated by script, macro or other automated means will be void. Sponsor reserves the right, at its sole discretion, to disqualify any individual found tampering with the contest. Entries will not be accepted in any other manner other than through the forms provided on the Website. Once submitted, all entry materials become the exclusive property of the Sponsor and will not be acknowledged or returned. Any person who attempts to participate under multiple identities or uses any artifice or device to accumulate entries will be disqualified.
5. ELIGIBILITY. contest is open only to individuals that reside in and who are physically located in the United States (excluding its territories and possessions, New York, Rhode Island, Florida and where prohibited by law) and are eighteen (18) years of age or older. The following categories of persons are not eligible to enter or win: employees of Kent Nutrition Group, Inc., its respective parent companies, affiliates, subsidiaries, sales representatives, and their immediate families (parents, children, siblings, spouse regardless of where they live) and those living in the same household (whether related or not) as such individuals. Void where prohibited by law.
6. MISCELLANEOUS. Winner will be notified by US Mail, and will be required to sign and return an affidavit of eligibility and liability/publicity release within fourteen (14) days of notification. Sponsor may select an alternate winner if winner fails to respond within timeframe specified or if winner fails to meet all eligibility requirements set forth herein. By participating, entrants agree to release and hold harmless KNG, its parent, affiliates, and subsidiaries, and their respective officers, directors, agents, and employees from any and all claims, damages, losses, expenses and liability arising out of participation in the contest, or acceptance/use of any prize. By accepting a prize, the winner agrees to the Sponsor’s use of his/her name and address (city & state), photograph, videotape or likeness for advertising, trade or publicity purposes and to the use of statements made by or attributed to the winner relating to the contest or Sponsor, and grants to Sponsor any and all rights to said use, in any media throughout the world, in perpetuity without further compensation, review, approval or notice, unless prohibited by law. Sponsor reserves the right to substitute a prize of equal or greater value at its discretion. Winner will be responsible for paying all fees and taxes (including sales and income taxes), resulting from winning the prize, and will be responsible for providing necessary personal information to the Sponsor to accomplish such requirements. Sponsor may terminate the contest or any portion thereof or decide to modify it in any manner, which it deems fair and equitable to participants if it becomes aware of any occurrence, which would materially affect the security, fairness, integrity or proper play of the contest. For the name of the winners, please submit a request by sending an email to webmaster@blueseal.com or a self-addressed, stamped envelope to Kent Nutrition Group, Inc., Attention Deborah Reddeck, P.O. Box 8000, Londonderry, NH 03053. Winners will only be disclosed after the prizes have been awarded.
7. OTHER CONDITIONS. If Sponsor cancels the contest, the prize will be awarded in a random drawing from eligible entries received as of the time of such cancellation. Sponsor is not responsible for incorrect or inaccurate entry information whether caused by equipment or programming associated with or utilized in the administration of the contest or by technical or human errors which may occur in the processing of the entries. By entering, entrants agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the contest, shall be governed by, and construed in accordance with, the laws of State of Iowa without giving effect to any choice of law or conflict of law rules. By entering, entrants consent to the jurisdiction and venue of the federal, state and local courts located in Iowa. Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the contest or to be acting in violation of these Official Rules.
